Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Dimaas ("Service"), operated by Mackbook İnşaat Ltd. Şti., a company registered in the Republic of Türkiye ("Dimaas", "we", "us"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Dimaas is a B2B trade fair lead intelligence and outreach platform. The Service helps exhibitors discover companies attending trade fairs, enrich contact information from publicly available sources, and send personalised invitations through WhatsApp Business and email channels with the account holder's consent and control.

3. Account & Eligibility

You must be at least 18 years old and authorised to bind the business you represent. You are responsible for the security of your credentials and for all activity under your account. You agree to provide accurate information during registration and to keep it up to date.

4. Subscriptions, Billing & Merchant of Record

All payments are processed by Paddle.com Market Limited("Paddle") acting as our Merchant of Record. Paddle handles payment processing, sales tax, VAT and invoicing on our behalf. Subscriptions renew automatically on a monthly basis at the price displayed at checkout unless cancelled. You can cancel anytime from your account dashboard or by contacting us.

Prices are listed in USD on the pricing page. Applicable taxes are added and shown at checkout. Renewal charges occur on the same day each month; failed payments may suspend access until resolved.

5. Acceptable Use

You agree not to use the Service to:

  • send unsolicited bulk communications that violate applicable anti-spam laws (CAN-SPAM, GDPR, KVKK, IYS, PECR or equivalent);
  • contact recipients who have opted out or who are on suppression lists;
  • impersonate other persons or businesses, or send misleading content;
  • scrape data in violation of WhatsApp's, LinkedIn's or any third-party terms of service;
  • resell, sublicense or repackage the Service or its data exports without written consent;
  • upload malware or attempt to compromise the platform's security.

You are solely responsible for the content of messages sent through the Service and for compliance with the laws of the jurisdictions of both sender and recipient. We may suspend accounts in case of confirmed abuse.

6. Customer Data

You retain ownership of any contact lists, messages or campaign data you upload ("Customer Data"). You grant Dimaas a limited licence to process Customer Data solely to provide the Service. We act as a data processor for Customer Data; you are the data controller. See our Privacy Policy for details.

7. Intellectual Property

The Service, including all software, design, text, graphics and trademarks, is owned by Dimaas or its licensors and is protected by intellectual property laws. We grant you a non-exclusive, non-transferable licence to access the Service for the duration of your subscription.

8. Termination

You may cancel at any time. We may suspend or terminate accounts that breach these Terms, with or without notice. On termination your access ends; we will retain or delete your data as described in the Privacy Policy.

9. Disclaimers & Limitation of Liability

The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, Dimaas disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. Dimaas's aggregate liability arising out of or relating to the Service shall not exceed the amount paid by you in the twelve (12) months preceding the event giving rise to the claim.

10. Refunds

Refunds are governed by our Refund Policy.

11. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-product notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Republic of Türkiye. Any dispute shall be submitted to the exclusive jurisdiction of the Istanbul Central (Çağlayan) Courts and Enforcement Offices, without prejudice to mandatory consumer-protection rules of the user's country of residence.
